| dc.description | Uno de los preceptos constitutivos de la responsabilidad objetiva del estado y su deber de reparación es la relación de causalidad, al ser el derecho un sistema lógico y racional esta no debe estar sujeta a subjetividades. Por lo que varias doctrinas han establecido distintos criterios de aplicación acerca de este precepto, son las teorías de la equivalencia de condiciones y la causalidad adecuada las que marcarían la pauta en distintas legislaciones. En el ordenamiento jurídico ecuatoriano, no es posible encontrar un claro desarrollo o tendencia acerca de la aplicación del nexo causal, variando en su mayoría los criterios de los juzgadores. | en_US |
| dc.description.abstract | One of the constitutive precepts of the objective responsibility of the state and its duty of reparation is the causal relation, since the law is a logical and rational system, it should not be subject to subjectivities. For what several doctrines have established different criteria of application about this precept, are the theories of the equivalence of conditions and the adequate causality that would mark the guide in different legislations. In the Ecuadorian legal system, it is not possible to find a clear development or trend about the application of the cause-effect nexus, varying mostly the criteria of the judges. | en_US |
