| dc.description | Hablar del derecho sucesorio y la posibilidad de salvaguardar los derechos de los animales dando la posibilidad de ser sujeto de derecho, es el tema a tratar. Este breve análisis busca aclarar aquellas dudas que se han producido a raíz de la actual Constitución en donde declara como sujeto de derecho a la naturaleza, abriendo la posibilidad de que el animal, la mascota, pueda adquirir derechos sucesorios, se analiza el tema de las asignaciones testamentarias dentro del Código Civil y su influencia en la Ley Orgánica de Bienestar Animal (LOBA), que concede derechos a los animales pero limitándose al derecho de protección. Lo que evidencia la existencia de una laguna respecto del tema. | en_US |
| dc.description.abstract | To talk about inheritance law and the possibility to save the rights of the animals and offer the possibility to be subject of law, it is the topic that want to cover. This brief analysis seeks to clarify those doubts that have arisen as a result of the current Constitution where it declares as subject of right to nature, opening the possibility that the animal, the pet, can acquire inheritance rights, the subject of the testamentary assignments with in the Codigo Civil and its influence on the Ley Organica de Bienestar Animal (LOBA), which grants rights to animals but limited to the right of protection.
