| dc.description | El presente ensayo académico presenta los presupuestos teóricos y fácticos de impacto jurídico que el autor sostiene deberían darse en un marco conceptual que permita el desarrollo sistémico de la lucha contra la corrupción y su anclaje en la decisión política y social de lidiar y erradicar este fenómeno, incluyendo algunos conceptos que han venido desarrollándose acerca del mismo y el análisis del tipo penal paradigmático que surge a partir de un encuentro venal entre un particular y un funcionario público: el cohecho, como tipo penal en la Legislación Ecuatoriana, sus antecedentes y su vinculación con otros tipos penales (enriquecimiento ilícito y peculado) dirigidos –desde el ámbito legislativo- a prevenir la corrupción y proteger el debido funcionamiento de la Administración Pública. | en_US |
| dc.description.abstract | The present academic essay presents the theoretical and factual presuppositions of legal impact that –according to the author- should be part of the framework in which systemic anti-corruption development must operate, anchored in the social and political decision to deal with and eradicate this phenomenon, including some of the concepts that have been developing around it. It also analyzes bribery as a crime, its treatment and history in the Ecuadorian Legislation, along with links to other crimes (Illicit Enrichment and misappropriation of Public Funds) necessary towards corruption prevention from the legislative standpoint in order to protect the proper functioning of the Public Administration. | en_US |
