| dc.description | El silencio administrativo es una figura jurídica que implica un castigo para el funcionario público por su inobservancia o inactividad ante un procedimiento en el que participan los administrados, pero se ha visto la mala aplicación de esta figura jurídica en Ecuador. Es por tal motivo que es necesario desarrollar el tema del uso indebido del silencio administrativo ante la justicia ecuatoriano, lo cual conlleva hacer un análisis de los casos en que se ha ejecutado mal esta figura jurídica, tema que será desarrollado en el primer capítulo. Para el desarrollo del segundo capítulo, se profundizará no solamente la jurisprudencia emitida, sino también del análisis de los artículos que contempla el silencio administrativo en el nuevo Código Orgánico Administrativo. Una vez terminada el análisis de la jurisprudencia, en concordancia con los cuerpos legales respectivos, procederé a la conclusión y recomendación personal debida. | en_US |
| dc.description.abstract | The administrative silence is a legal figure that implies a punishment for the public official for his non-observance or inactivity before a procedure in which the administered ones participate, but the bad application of this legal figure has been seen in Ecuador. It is for this reason that it is necessary to develop the issue of misuse of administrative silence before the Ecuadorian justice, which entails making an analysis of the cases in which this legal figure has been poorly executed, an issue that will be developed in the first chapter. For the development of the second chapter, it will deepen not only the jurisprudence issued, but also the analysis of the articles contemplated by administrative silence in the new Organic Administrative Code.
