Regulación de la maternidad subrogada en Ecuador.

Abstract

This research work will talk about the topic of surrogate motherhood in Ecuador or better known as the surrogate belly, because the practice of this type of motherhood is now being used more frequently by Ecuadorians, in addition to being a topic discussed in the Law Project for the Organic Health Code. Within the first chapter, some significant concepts about assisted reproduction will be mentioned, which will lead to a greater understanding of surrogate motherhood, which is, what it consists of and why it is important for Ecuador to regulate this issue by Ecuadorians’ law. As a second point, the possibility of including surrogate motherhood in Ecuadorian legislation will be addressed, causing that the requesting parties and the woman who rents her womb, would enter into a surrogate maternity contract with similar characteristics as a hiring services contract in order to avoid conflicts between the parties at the end of the gestation period.
