Aproximación jurídica a los conocimientos tradicionales en el Ecuador.

Abstract

The purpose of this research work is to explore the topic of the protection of ancestral knowledge that belong to the different communities in Ecuador, whose rights have been, for a long time, violated with the misappropriation by third parties with the purpose of profiting themselves without these communities receiving any benefit or recognition of their rights. The concept of what traditional knowledge, its transcendence, the collective intellectual property linked to this issue and the current situation of these within our legal system will be analyzed. The regulation and recognition of the traditional knowledges are necessary for the indigenous communities and their knowledge, so it´s necessary to contemplate on what would be the best for the future so that their protection is guaranteed and the representatives of each indigenous community in Ecuador can both prevent and act against any illegal appropriation or abuse.
