Abstract

Regardless of the purpose that each society has chosen, from its punitive power arises the question of whether there are factors and conditions imperative for that goal to be fulfilled; and, if this is the case, it is necessary to understand that, without these conditions, it is not possible to achieve compliance with the goal of the penalty in other scenarios. Having said that, it is noted that the system of execution of penalties faces the challenge of achieving harmony, relevance and, therefore, effectiveness, through the recognition and application of these factors, once the system clarifies its intentions and purposes. Determining the purpose of punishment is not only an endless discussion, but also a step before the search for better conditions around the execution of punishment, so it is necessary to establish what a society's position is, in order to achieve the correct conditions of fulfilment under that end, highlighting the minimum expectations.
