Análisis de la subasta inversa electrónica en el sistema de contratación pública ecuatoriano.

Abstract

The subject of this degree work is "Analysis of the Electronic Reverse Auction in the Ecuadorian public contracting system". The question that is intended to be answered is: What are the deficiencies of the Electronic Reverse Auction within the public contracting process? For this purpose, the degree work will be divided into three chapters. In the first chapter entitled "The Electronic Reverse Auction: definition and contracting procedure", the background of Public Procurement and Electronic Reverse Auction will be addressed, the concept of Reverse Auction, the functionality of the National Service of Public Procurement, Official System of Public Procurement, Procurement Facilitator Module and the procedure, phases and stages of the Electronic Reverse Auction will be identified. In the second chapter entitled "Flaws of the Electronic Reverse Auction procedure", an analysis will be made regarding the violation of legal regulations by bidders when knowing the reference budget and violation of the principle of equality and fair treatment detected in the Reverse Auction , the obligation to cancel and declare void the processes in the event of non-compliance with the schedule will be addressed, and the wear of time detected in the different stages of the Electronic Reverse Auction will be analyzed. Finally, the third chapter will analyze the conclusions and recommendations of the investigative work.
