| dc.description | Dentro del Código Civil, en el libro III, Título XIII, en el cual se desarrolla todo lo concerniente a las donaciones entre vivos, nos encontramos con la figura de la revocación de la donación por ingratitud. El mismo artículo 1444 nos indica que “la donación entre vivos puede revocarse por ingratitud”, y que se tiene por acto de ingratitud “cualquier hecho ofensivo del donatario, que le hiciera indigno de heredar al donante”. Al momento de incoar el plano procesal, nos resulta inquietante establecer que es un hecho ofensivo, lo cual queda de manera obscura, vaga indeterminada. Está claro que no hace referencia solo a indoles de carácter penal, sino moral o ético, pero incluso para este, deben existir parámetros a considerar y no dejarlo de forma subjetiva. La hipótesis, por lo tanto, se centra en el peligro de la indeterminación del alcance del hecho ofensivo, y por qué debería implementarse criterios o ejemplos. | en_US |
| dc.description.abstract | In the Civil Code’s book III, Title XIII, where everything concerning donations inter vivos is developed, we find the figure of revoking the donation due to ungratefulness. Article 1444 says that “a donation inter vivos can be revoked due to ungratefulness” and that ungratefulness refers to “any offensive act by the donee, which made them unworthy of inheriting the donor”. When starting the procedural plane it becomes unnerving to establish what is an offensive act, something which is left vague, obscure and undetermined. It is clear that it makes no reference only to acts of criminal nature, but rather of moral or ethical nature, however even for this, there must be parameters to consider and not to be left in a subjective fashion. Therefore, the hypothesis revolves around the danger of the indeterminacy of the offensive act reach, and why there ought to include some criteria or examples. | en_US |
