Abstract

It is essential to ensure that students are free from sexual violence in order to protect their physical, emotional, and academic well-being. A safe and respectful educational environment fosters effective learning and healthy development. Sexual violence can have devastating effects on students' self-esteem, academic performance, and mental health. In this context, the present study addresses the compliance with due process in the administrative sanctioning procedure (administrative summary) for sexual violence in public educational institutions, emphasizing the crucial importance of safeguarding the rights of children and adolescents. The study proposes a qualitative research approach, using theoretical methods such as analysis-synthesis and descriptive methods. Through this methodological approach, the application of administrative sanctioning authority was analyzed, and several deficiencies in the due process of the administrative summary were identified. This study underscores the need to address these deficiencies in order to promote a safe and protected educational environment, where the human rights of all parties involved are fully respected. The search for comprehensive solutions is key to fostering trust in justice institutions and ensuring that students can thrive in environments free from violence and harassment, thereby complying with international human rights standards and ensuring a fairer and more equitable future for children and youth.
