Abstract

Within this work, the theme of surrogate mothers of disabled children will be developed. Both labor regulation in the private and public sectors can be observed, since the central issue lies in the need to keep a job for a surrogate mother for the corresponding support of her children and more so in the complicated conditions in which they find themselves. The Constitution provides for the priority group of children and adolescents and the disabled, who have full access to their rights and must not discriminate against them in any way. In this sense, it will be possible to appreciate the need to update legal norms to be in harmony with the protection of the rights of this vulnerable group. Finally, the importance of work for a surrogate mother will be highlighted and that it is in dignified conditions where she is provided with the facilities to perform her functions both for the employer and for her own home.
