| dc.description | La Inteligencia Artificial ha producido avances relevantes, pero también retos en la salvaguarda de derechos esenciales como la privacidad y la protección informativa. La expansión de deepfakes, voces artificiales y simulaciones visuales promueve la alteración de datos y la perpetración de crímenes como estafas y campañas de desinformación. En este aspecto, los marcos legales vigentes presentan lagunas jurídicas que complican la detección y penalización de los culpables. Este estudio examina el efecto de la IA en la privacidad y analiza el Proyecto de Ley de Protección de Datos en Ecuador, valorando su habilidad para regular de manera efectiva la utilización de estas tecnologías. Se analizan los fundamentos legales que deben guiar su uso, garantizando un equilibrio entre la innovación y la salvaguarda de derechos. Así también, se investiga teorías legales como la causalidad y la imputación objetiva, que pueden ayudar a establecer responsabilidades en situaciones de infracción de derechos a través IA. | en_US |
| dc.description.abstract | Artificial Intelligence has produced advances and challenges in safeguarding essential rights such as privacy and information protection. The expansion of deepfakes, artificial voices, and visual simulations promotes the alteration of data and the perpetration of crimes such as scams and disinformation campaigns. In this regard, the current legal frameworks have legal gaps that complicate the detection and punishment of the culprits. This study examines the effect of AI on privacy and analyzes the Data Protection Bill in Ecuador, assessing its ability to effectively regulate the use of these technologies. The legal foundations that should guide their use are analysed, guaranteeing a balance between innovation and the safeguarding of rights. Likewise, legal theories such as causality and objective imputation are investigated, which can help establish responsibilities in situations of infringement of rights through AI. | en_US |
