Resumen :	In the present juridical research work, the issue of State responsibility in the protection of children against organized violence in Ecuador is addressed, emphasizing the growing vulnerability of childhood in the face of the expansion of criminal groups, the increase in violent crimes, and institutional fragility. The study is grounded in Article 44 of the Constitution of the Republic of Ecuador, which establishes the prevalence of the rights of children and adolescents, as well as in international instruments such as the Convention on the Rights of the Child and the jurisprudence of the Inter-American Court of Human Rights, which reinforce the State’s obligation to guarantee the best interests of the child. The research identifies a contradiction between the constitutional and international normative framework and the insufficiency of public security and protection policies, which generates State responsibility by omission. It analyzes the fundamental rights of children, such as the right to life, personal security, and integral protection, together with the applicable national legislation, including the Organic Code of Childhood and Adolescence and the Organic Law of Jurisdictional Guarantees and Constitutional Control. Likewise, it examines the tensions between security policies and child protection, highlighting risks such as forced recruitment and the criminalization of adolescents. The study proposes strengthening integral protection through normative reforms, inter￾institutional coordination, and public policies with a human rights approach, ensuring prevention, protection, and reparation in the face of organized violence.
Descripción :	En el presente trabajo de investigación de tinte jurídico, se aborda la responsabilidad estatal en la protección de niños frente a la violencia organizada en Ecuador, destacando la creciente vulnerabilidad de la niñez ante el avance de grupos criminales, el incremento de delitos violentos y la fragilidad institucional. Se fundamenta en el artículo 44 de la Constitución de la República del Ecuador, que establece la prevalencia de los derechos de niños, niñas y adolescentes, y en instrumentos internacionales como la Convención sobre los Derechos del Niño y la jurisprudencia de la Corte Interamericana de Derechos Humanos, que refuerzan la obligación estatal de garantizar el interés superior del niño. La investigación explica que hay una contradicción entre lo que dicen la Constitución y las leyes internacionales y lo que realmente hacen las autoridades para proteger a los niños y adolescentes. Esto provoca que el Estado tenga responsabilidad cuando no actúa como debería. También se habla de los derechos más importantes de la niñez, como el derecho a la vida, a la seguridad y a recibir protección. Además, se mencionan leyes nacionales que tienen que ver con este tema, como el Código Orgánico de la Niñez y Adolescencia y la Ley Orgánica de Garantías Jurisdiccionales. Asimismo, se examinan las tensiones entre políticas de seguridad y protección infantil, señalando riesgos como el reclutamiento forzado y la criminalización de adolescentes. El estudio propone fortalecer la protección integral mediante reformas normativas, coordinación interinstitucional y políticas públicas con enfoque de derechos humanos, asegurando prevención, atención y reparación frente a la violencia organizada.
