dc.descriptionEl trabajo parte del reconocimiento del querellante como víctima, en donde, en este tipo de acciones, la víctima asume la titularidad de la persecución penal, propiciando un contexto de mayor fragilidad frente a sus derechos, especialmente en casos relacionados con delitos cuyo hecho controvertido suele involucrar conflictos interpersonales, existiendo una omisión por parte del legislador dentro del Código Orgánico Integral Penal al momento de normar un mecanismo que garantice la protección de los derechos fundamentales del querellado. A pesar de que la ley contempla medidas de protección, no está en claro sobre cómo tramitarlas durante el ejercicio privado de la acción penal. Esta deficiencia normativa genera preocupantes consecuencias jurídicas ante quien interpone la querella, existiendo una posible revictimización junto al riesgo constante que caracteriza un proceso penal. Finalmente, se evidencia que existen garantías constitucionales que abordan de manera general y positiva los derechos de las víctimas, pero que existen casos donde este garantismo no es suficiente, contrastando con la legalidad y formalismo de la norma, teniendo como resultado la necesidad de reformar el Código Orgánico Integral Penal, artículo 520, numeral uno, habilitando el uso de medidas de protección en el ejercicio privado de la acción penal.en_US
dc.description.abstractThis study begins by recognizing the private complainant as a victim role in which the individual assumes responsibility for driving the criminal prosecution. This creates a context of heightened vulnerability regarding their rights, particularly in cases involving offenses where the underlying dispute often stems from interpersonal conflict. A legislative omission exists within the Organic Comprehensive Penal Code (Comprehensive Organic Criminal Code) regarding the regulation of mechanisms to guarantee the protection of the private complainant's fundamental rights. Although the law provides for protective measures, the procedure for implementing them during the private exercise of criminal action remains unclear. This regulatory deficiency leads to concerning legal consequences for the person filing the complaint, creating a risk of re-victimization alongside the inherent stresses of criminal proceedings. Ultimately, while constitutional guarantees address victims' rights in a general and positive manner, there are instances where these protections prove insufficient when weighed against the strict legality and formalism of the statute. Consequently, there is a need to reform Article 520, numeral 1, of the Organic Comprehensive Penal Code to authorize the use of protective measures during the private exercise of criminal action.en_US
