The Tenth Transitory Provision of the Organic Law for the Reform and Strengthening of the Penitentiary System establishes an explicit mandate that the National Social Rehabilitation System must have a public policy on internal work and identify inmates eligible for employment. This has led to interpretations regarding the potential responsibility for prison labor. The objective of this study is to examine the scope of this policy and whether it constitutes an individual duty of inmates or an institutional duty of the National Social Rehabilitation System. To this end, we conducted qualitative and legal research, analyzing normative, jurisprudential, and documentary sources such as the Constitution, the Comprehensive Organic Criminal Code, the reform legislation, the Regulations of the National Social Rehabilitation System, international instruments, and comparative jurisprudence and legislation. The results showed that there is a mandate directed at the National Social Rehabilitation System, rather than a specific individual obligation to work. Furthermore, we have found that the principle of voluntariness, as established in Article 9 of the Comprehensive Organic Criminal Code, continues to apply to the participation of inmates in social rehabilitation. Therefore, we propose a regulatory clarification for the implementation of the public policy on internal work, with clear rules that are in line with voluntariness, human dignity, legal certainty, and the rights of inmates.en_US
