Exclusividad del arbitraje como mecanismo de solución de controversias en el derecho deportivo.

Abstract

Sports law is a growing branch of law, which regulates the relationships and situations arising from the sports world. The following research paper has its focus center on arbitration as an alternative disputes resolution mechanism within sports law of football soccer. Inside football´s world, the controversies arisen are submitted to and resolved by arbitral proceeding, according to the clauses included in the contracts or in the sporting organizations bylaws, that tame and regulate sports. In the following research paper, it will be analyzed whether arbitration, as an alternative disputes resolution, is voluntary or mandatory. First of all, arbitration will be analyzed in a general way, it will be thought through the basis of the thoughts of jurists, bylaws, acts, whether arbitration is voluntary or not; as well as the issues subject to arbitration. To conclude, the study of the bylaw that stablishesa prohibition to bring sporting issues on to ordinary courts, leaving thisway free just for labor issues.
