Abstract

The electronic contract is a new way of implementing a contract through the use of an electronic medium. The electronic contract has the same elements of any contract capacity, consent, object and legal cause. Regarding consent, it is necessary to bear in mind the way in which it is granted through the use of an electronic means, since there may be cases where there may be vices of consent that will not allow the contract to be perfected. In Ecuador the law of electronic commerce, signatures and data message, does not have a regulation as such on the consent granted through the use of an electronic medium, if not it refers to the commercial code, in which the consent is given by the offer and acceptance, this form is valid in electronic contracts, but there are other ways to grant consent either by Click and wrap agreements and Browse wrap, which is not regulated by Ecuadorian law.
