La motivación del arbitraje en equidad.

Abstract

The advantages offered by the arbitration procedure have resulted in people increasingly choosing this procedure instead by the ordinary courts. Our legislation is not alien to this institution and is regulated by the Ley de Arbitraje y Mediación. One of the forms of arbitration classification consists of arbitration in equity and arbitration in law. This academic article aims to analyze specifically the motivation of equity arbitration, since, as we will see later, the essential characteristic of this procedure is that the arbitrator must not legally motivate its resolution. To land at this specific institution and obtain a greater understanding, I will briefly explain the arbitration jurisdiction.
