El derecho a la resistencia: una radiografía básica en el contexto sur y centro americano.

Abstract

In this work we sketch a basic radiograph about the right to resistance in Central and South America. To this proposal we identify so many categories with the aim of characterize round them central bearings predicted for the Constitutions that we look at. Nine of seventeen countries of Central and South America talk in their Constitutions about the right to resistance. Reviewing the constitutional case law, we found that three Supreme Courts contribute reflexively to the making of that right. It is usually understood that thinking in some type of regulation for it exercise would be a contradiction with the nature of this especial right; however, an objective of this job was to auscultate the existence of legal systems that allow for it exercise.
