Valor probatorio de la prueba documental de contenidos digitales durante la etapa de juicio en el Derecho Procesal Penal Ecuatoriano.

Abstract

In the Ecuadorian penal system there are three types of evidence: documented, testimonial and expert. The below piece of work delves into documented evidence, specifically documented evidence that is digital. When the judge gives his sentence, it will be based upon and motivated by evidence. Because of this, these evidences must adhere to and comply with the valuation criterion determined in the Integrated Organic Penal Code. One of the criteria is submitting to the custody chain. This investigative work will showcase that in the valuation of documented digital evidence, this too must be submitted to the custody chain. Not complying to this would further diminish and take value away from the evidence.
