Abstract

Although Ecuador has signed International Treaties of cooperation between countries to ensure an effective protection of minor’s rights, there are barriers that make it difficult to access to maintenance when the obligor is abroad. The present work analyzes the existing faults in the current law, with the purpose of obtaining an improvement in the execution of alimony payments abroad, guaranteeing in this way the protection of the inherent and irrevocable right of child support in line with the best interests of children. In this way, several questions arise. How can the current procedure for alimony payments be improved? Are there the necessary resources for an effective collaboration between countries in these cases? And finally, are these kinds of requirements given enough relevance?
