Aplicación del sistema de folio real y la matrícula inmobiliaria en el registro de la propiedad del cantón Ibarra.

Abstract

The principle of legal security is often being infringed in the Registry Law field due to not having certainty in the legal property traffic. Therefore, the aim of the present investigation is to install a real file system and a real-state enrollment for the Registro de la Propiedad del Cantón Ibarra, Provincia de Imbabura, since the application of a typical modern real file system promotes a proper operation and has the property as a base; and, the use of the real-state enrollment that has consistency with the registry information will allow to ensure compliance to this great principle. The methodology applied to this research involves theoretical methods such as: logical-historical method, doctrinal legal systematization, synthesis-analysis; additionally, empiric methods as the documental analysis, comparative legislation and interviews. This is how the importance of this research has emerged to protect the citizens’ interests that day by day request for an inscription. To conclude, it can be established that the application of the real file system and the usage of the real-state enrollment bestow registry attestation and the guarantee of the legal security principle.
