Abstract

The notarial function executes and provides security to legal relations, which is one of the purposes of the law, government platforms in our country comply with the constitutional principles of efficiency and effectiveness as a support for the public function, the notarial activity is subject to the functionality, availability and fluidity of these systems, when it is established that the notary must act at the request of a party at the same time that their action is required. The objective is to: Identify the subordination of the notarial function to the disabling of government platforms. The methodology used includes: Historical-Logical method, Legal-doctrinal Systematization and Analysis - Synthesis, additionally as empirical methods documentary analysis, interview and case analysis. As a result, we have been operating SIN since 2015, a period in which the system has not been optimized despite possible conflicts in its use; none of the aforementioned regulations, determines that the use of a computer system is vital, irreplaceable and mandatory for the notarial exercise; The system as a tool must optimize the public service and not limit it or exceed the powers given by the Law. When determining the need to improve the technology of the SIN and the communication channels, it transcends in the proposal of the promulgation via resolution of a “Manual of user for computer platform failures ”and to establish periodic training and efficient communication to solve problems that are generated with the use of the SIN and the interface of the various government platforms.
