Abstract

The purpose of this research work is to analyze obligations of conjugal society against article 44 implementation in the new Commercial Code. Once the progress of the normative regarding representation of conjugal society has been reported, proceed to define: merchant, marital partnership, marriage certificates, and dissolution of conjugal society to have a better development of the theme, with the characteristics of the obligations of conjugal society. On the other hand, the scope of article 44 of the Commercial Code from which different changes arise: 1) It facilitates the proof of the conjugal society to which it was obliged without the need to prove that it benefited. 2) It falls on goods that were the object of commercial activity. 3) The quality they should have as a legal representative of the marital partnership.
