| Résumé: | This investigation makes a deep analysis of how the incoterms 2020 and the obligations contracted by them interacts with Ecuadorian law and what it establishes about the sale of goods. In this way, this essay pretends to identify if the incoterms as a repetitive act used by the agents that intervene in maritime transactions, repeal, modify or interpret the obligations contained in the dispositions of Ecuadorian Commerce Code and its law in general. |
| Description: | El presente trabajo de investigación hace un análisis profundo de la interacción entre los incoterms y las obligaciones contenidas en la normativa ecuatoriana respecto de las compraventas marítimas. De esta forma el trabajo pretende identificar si los incoterms, como uso o costumbre del comercio internacional, derogan, modifican o interpretan las obligaciones contenidas en el Código de Comercio, Código Orgánico de la Función Judicial y Código Orgánico General de Procesos. |
