Abstract

The affirmative action or also known as positive discrimination, its indications were in the United States, currently it is used as an instrument of protection towards people who belong to the group of victims, who have been isolated by certain characteristics that they possess, such as being indigenous, their religion, being a woman, disabled, among others, as a result they were separated from others. These people had to endure abuse for many years, such as not being able to access their rights like any human being and countless similar situations. State laws through public policies created various benefits for the injured, thus including them in everyday life and being part of the mandate, with the purpose of eliminating the feeling of inferiority compared to others and access their rights equally, under the protection of constitutional norms.
