La protección del consumidor frente al delito aduanero de contrabando en Ecuador.

Abstract

This titling work deals with a research of the Organic Law for defense of the consumer and the lack of protection of the State aimed at protecting it from the effects derived from customs crime of smuggling, which is the topic of this project. The various effects of smuggling typified in the Comprehensive Organic Criminal Code, whose consequences include tax evasion and economic trade damages but it also entails a serious impact on the assets of one of the priority attention groups stipulated by the constitution, such as the figure of the consumer. The investigation will deal with the lack of a legal basis to defend the consumer from one of the illicit commercial activities, that is, smuggling; and in turn analyze the role of the State in the fulfillment of its highest duty to enforce the rights of its citizens within the legal framework. This project will frame the need to develop an accurate protection framework in order not to leave consumers unaware that the product they have purchased has been the result of contraband.
