| dc.description | El presente trabajo explica el concepto de una situación de emergencia, para entrar a analizar el ordenamiento jurídico vigente en relación a la Contratación Pública en Situación de Emergencia en Ecuador, en lo concerniente a los controles que se realizan a lo largo de este procedimiento especial. Además, se examinará Legislación Comparada a manera de encontrar ejemplos a seguir en cuanto a la fiscalización que se realiza en otros países, señalando el contraste existente entre estas y la legislación ecuatoriana. Se comentarán también los cambios referentes a la contratación de emergencia en la Ley Orgánica del Sistema Nacional de Contratación Pública incluidos a manera de disposiciones reformatorias dentro del Proyecto de Ley Orgánica Reformatoria del Código Orgánico Integral Penal en Materia Anticorrupción, cuyo texto fue aprobado en la Asamblea Nacional en diciembre del 2020. Lo anterior con la finalidad de determinar las falencias y vacíos en la normativa de control para así recomendar una reforma que coadyuve hacia la correcta utilización de este régimen. | en_US |
| dc.description.abstract | This paper explains the concept of an emergency situation, in order to analyze the current legal system regarding Public Contracting in an Emergency Situation in Ecuador, pertaining the controls carried out throughout this special procedure. In addition, Comparative Legislation will be examined in pursuance of finding examples to follow with regards to the control carried out in other countries, pointing out the contrast between these and the Ecuadorian legislation. The changes referring to Emergency Contracting in the Organic Law of the National Public Contracting System included as reform provisions within the Bill of Organic Law Reform of the Comprehensive Organic Criminal Code on Anti-Corruption, which text was approved in the National Assembly in December 2020, will also be discussed. The foregoing with the purpose to determine the shortcomings and voids in the control regulations in order to recommend a reform that contributes towards the correct use of this regime. | en_US |
