Abstract

This paper explains the concept of an emergency situation, in order to analyze the current legal system regarding Public Contracting in an Emergency Situation in Ecuador, pertaining the controls carried out throughout this special procedure. In addition, Comparative Legislation will be examined in pursuance of finding examples to follow with regards to the control carried out in other countries, pointing out the contrast between these and the Ecuadorian legislation. The changes referring to Emergency Contracting in the Organic Law of the National Public Contracting System included as reform provisions within the Bill of Organic Law Reform of the Comprehensive Organic Criminal Code on Anti-Corruption, which text was approved in the National Assembly in December 2020, will also be discussed. The foregoing with the purpose to determine the shortcomings and voids in the control regulations in order to recommend a reform that contributes towards the correct use of this regime.
