Abstract

This study will be carried out within the context of Ecuador's constitutional law on citizen participation, but using the mechanism of the empty chair, as envisioned in the Organic Code of Territorial Organisation, Autonomy, and Decentralization and used by Ecuador's Decentralized Autonomous Governments. However, considering the lack of socialization and legislation, it will be determined if the public is conscious of this human right or whether there is a lack of interest. Decentralized Autonomous Governments must control and define the conditions in order for a real exercise to take place. As a result, the aim of this study is to propose improvements by showing how the right to use the empty chair as a tool for participation and a measure of mutual needs fulfillment in Ecuador can be implemented and accepted in a positive way. Via a documentary investigative technique, which will allow us to check the hypothesis posed by not just a careful analysis of hypotheses, laws, or determining the existence of legal journals that have socialized this right.
