El Smart Contract y su naturaleza jurídica.

Abstract

As new technologies influence our lives day by day, they have also come to influence the right legal sphere. In this case, different ways of contracting star to emerge, not only the using of conventional form that we already have been accustomed to, but currently using electronic devices or methods to facilitate communication between people, the acquisition of different things and services. Expressing your interests just giving a "click". Therefore, thanks to the revolution in the world of cryptocurrencies and with the presence of the Blockchain trend, the way of contracting has evolved. The present work wants to present a new legal figure called “Smart Contract” which has been living with us for a couple of years, but which specifically in Ecuador has legally emerged in 2019 with the entry of the new Ecuadorian Commercial Code. We must add that, we will know how it arose, where it came from, its use, the opportunities it can offer us, the problems that may arise and how it works in the legal field, in turn we will also know how important it has become in this society the use of these new technologies. Since at the end of the day, they help us in different areas of our lives, and in this specific case it has given a twist to the world of contract law.
