| Résumé: | This academic work deals with a study of the right to equality and non-discrimination, specifically regarding migration policies and equal rights between nationals and foreigners. That regarding the migration policies established by the social context of the region. The large number of refugees and migrants who have entered the Republic of Ecuador, and how the regulations regarding this situation must respect the parameters established by the Magna Carta. Now, to determine this, a review of the legal and jurisprudential precepts on the subject is necessary. The same ones that will be recognized in the research development. Considering in turn what refers to the existing limits in this supposed absolute equality of rights, or this non-differentiation between nationals and foreigners that the Ecuadorian Constitution manifests, approaching the legal practical reality of the subject in question, and as from That should be presented in the future rules that regulate the aforementioned subject. |
| Description: | El presente trabajo académico versa sobre un estudio al derecho a la igualdad y la no discriminación, en concreto respecto de las políticas migratorias y la igualdad de derechos entre los nacionales y los extranjeros. Aquello respecto de las políticas migratorias establecidas por el contexto social de la región. La gran cantidad de refugiados y migrantes que han ingresado a la República del Ecuador, y como la normativa acerca de esta situación debe respetar los parámetros establecidos por la Carta Magna. Ahora bien, para determinar aquello es necesaria la revisión de los preceptos legales y jurisprudenciales referentes al tema. Los mismos que serán reconocidos en el desarrollo investigativo. Considerando a su vez lo referente a los limites existentes en esta supuesta igualdad absoluta de derechos, o esta no diferenciación entre los nacionales y extranjeros que manifiesta la Constitución ecuatoriana, acercándonos a la realidad práctica jurídica de la temática en cuestión, y como a partir de aquello se deben presentar las futuras normas que regulen la referida temática. |
