| Résumé: | Talking about the right that animals have, especially when talking about the possibility that they are recognized for what they are, subjects of the right, the protection of animals is the subject to be discussed. This brief analysis seeks to reform articles 32 and 33 of the Organic Law of Animal Welfare, emphasizing its contradictions and gaps found in the aforementioned articles, in this way, protecting the animal as a subject of law, as mentioned the current constitution when it refers to nature, recognizing the animal, domestic and wild, analyzing the obligations that the owners have and the prohibited acts against animals, granting rights to animals, but having a lack of protection over animals , which shows a legal loophole. |
| Description: | Hablar del derecho que tienen los animales, sobre todo, al hablar sobre la posibilidad de que sean reconocidos como lo que son, sujetos del derecho, la protección sobre los animales es el tema para tratar en el siguiente tema de investigación. Este breve análisis busca reformar los artículos 32 y 33 de la Ley Orgánica del Bienestar Animal, haciendo énfasis a sus contradicciones y vacíos que se encuentran en los artículos mencionados, de esta manera, proteger al animal como un sujeto de derecho, tal como lo menciona la constitución actual cuando se refiere a la naturaleza, reconociendo al animal, doméstico y silvestre, como sujeto de protección constitucional, haciendo análisis sobre las obligaciones que tienen los titulares y los actos prohibidos contra los animales, concediéndole derechos a los animales, pero teniendo carencia sobre la protección sobre los animales, lo que evidencia una laguna legal en el apartado de la comercialización, al menos, en su regulación y protección en todo el proceso que se debe tener para que un animal sea comercializado, desde su hábitat, alimento, criadero, crianza y venta. |
