Análisis del derecho al trabajo en Ecuador como garantía constitucional en tiempo de pandemia.

Abstract

The sanitary emergency in Ecuador due to the Covid-19 pandemic, not only changed the dynamics of our daily life, but also the legal reality. When we talk about labor rights, we invoke the regulation of bilateral obligations within the scope of work, definition according to the Elementary Legal Dictionary of Cabanellas (2016). Both the Organic Law of Public Service- LOSEP, as well as the Labor Code have not foreseen that the health emergency caused by Covid-19 would lead to a wave of layoffs in breach of the constitutional guarantees by which workers are protected in Ecuador. It is important to mention that the pandemic is not an easy scenario worldwide, but it is not justifiable that the termination of labor relations in Ecuador has become a mechanism to safeguard the economy of companies, leaving aside the right of workers at a time when there is greater social vulnerability.
