Abstract

This thesis was carried out using the quantitative research method, which sought to determine the problems that have generated the crisis of the prison system in Ecuador, pointing out the constitutional and penal norms necessary to promote important changes in the Ecuadorian prison system, in order to protect the rights of persons deprived of liberty and rehabilitate them. In the work I point out the possible ways to provide education to inmates in prisons; I explain the importance of determining individually the factors that led the convict to have criminal behavior in order to develop an individualized treatment that allows an effective rehabilitation and social reintegration; I present alternative means to the prison sentence to reduce overcrowding in prisons; I illustrate new methods from other countries, which have given good results for the education and treatment of inmates. To conclude with recommendations to be taken to reform the penitentiary system, thus complying with the law.
