| dc.description | El sistema de Propiedad Intelectual está encaminado a la protección de las creaciones humanas fruto del ingenio propio de la persona, esta protección se efectiviza de distintas formas, siendo la normativa vigente (Ley de Propiedad Intelectual y Código Ingenios) el fundamento para que el estado tutele los derechos derivados de esta rama. Es así que el sistema penal ecuatoriano ha incorporado en su legislación los tipos penales necesarios para sancionar cualquier atentado que se de en contra del bien jurídico protegido en el que se convierte la Propiedad Intelectual; sin embargo, esta normativa no es suficiente y no cumple con el régimen de aplicabilidad de los Tratados Internacionales que regulan esta materia. | en_US |
| dc.description.abstract | The Intellectual Property system is aimed at the protection of human creations resulting from the person's own ingenuity, this protection is made effective in different ways, being the current regulations (Intellectual Property Law and Ingenios Code) the basis for the state to protect the rights derived from this branch. Thus, the Ecuadorian criminal system has incorporated into its legislation the criminal types necessary to sanction any attack against the protected legal asset that Intellectual Property becomes; however, this regulation is not sufficient and does not comply with the applicability regime of the International Treaties that regulate this matter. | en_US |
