Resumen : The savings and credit cooperatives in Ecuador have reached a position in a very important financial sector, especially at the level of the province of Oro, which is the territory of study in the research; where the practice of the popular economy in these entities as a result of the current Organic Law of the Popular and Solidarity Economy as well as the Popular and Solidarity Financial Sector annexed to their respective regulations, being laws that have allowed the administration of sectors, which They are more vulnerable in Ecuadorian society, from a development and cooperation perspective, that is, that they meet the needs of their citizens where currently the regulations of the Organic Monetary and Financial Code of the country have a legal structure to regulate entities financial institutions and among them are the savings and credit cooperatives. Without undermining the work carried out by the Superintendency of Popular and Solidarity Economy, the same entity that together with other control entities have managed to withdraw from the financial environment all those entities that were listed as cooperatives but that did not meet all the requirements demanded by the law for its operation. But there is still a need to improve our legislation in the country in the area of the "Popular and Solidarity Financial Sector" of the "Savings and Credit Cooperatives"; to guarantee the proper functioning and grant guarantees to the partners by proposing an alternative solution as a reform to the Organic Law of Popular and Solidarity Economy of the Popular and Solidarity Financial Sector.
Descripción : Las cooperativas de ahorro y crédito han logrado ubicarse en un sector financiero de mucha importancia en el Ecuador y en especial a nivel de la provincia de El Oro que es territorio de estudio en la investigación; con la práctica de la economía popular en estas entidades a raíz de la actual norma Ley Orgánica de la Economía Popular y Solidaria así como también del Sector Financiero Popular y Solidario anexo a su respectivo reglamento, al ser leyes que han permitido administrar a sectores, que resultan más vulnerarles en la sociedad ecuatoriana, desde una óptica para el desarrollo y la cooperación, es decir que cumplan con las necesidades de sus ciudadanos donde actualmente la normativa del Código Orgánico Monetario y Financiero del país tiene una estructura de nivel jurídico para regular a entidades financieras y entre ellas están las cooperativas de ahorro y crédito. Sin menoscabar el trabajo realizado por la entidad Superintendencia de Economía Popular y Solidaria, misma que en conjunto con otras entidades de control han logrado retirar del medio financiero a todas aquellas entidades que constaban como cooperativas pero que no reunían con todos los requisitos exigidos por la ley para su funcionamiento, aún existe la necesidad de mejorar nuestra legislación en el país en el ámbito del “Sector Financiero Popular y Solidario” de las “Cooperativas de Ahorro y Crédito”; para garantizar el buen funcionamiento y otorgar garantías a los socios a través de proponer una solución alternativa como reforma a la Ley Orgánica de Economía Popular y Solidaria del Sector Financiero Popular y Solidario.
