| Resumen : | The present work deals with the analysis of the current issuance of testimonies and certificates at the notarial headquarters, the purpose of this exam is to support the modernization of the notarial system, the digitization of notarial documents today, considering said modernization; as a tool in order to guarantee the subsistence of legal acts, which fundamentally facilitates, not only the search of the files, but the issuance of testimonies and certificates online, and also allow the user to have the conviction of legal certainty upon issuance of said documentation in accordance with the law establishes it. For the realization of the objectives, this exam is based on a non-experimental investigation, with a qualitative approach; explanatory, documentary type; that handles theoretical and empirical methods, also focused on the provisions of art. 19 of the Notarial Law, and arts. 4, 6 and 9 of the Regulation of the Comprehensive Notarial System of the Judicial Function, which contemplates the non-obligation of digitization of notarial documents from the archive, nor the consideration of the use of a computer system to carry out a specific search, as stated in the interest of to substantiate the need to modernize the notarial system regarding the issuance of testimony and certificates online. |
| Descripción : | El presente trabajo trata del análisis de la actual expedición de testimonios y certificados en sede notarial, el propósito del presente examen es el de fundamentar la modernización del sistema notarial, en concreto, la digitalización de los documentos notariales en la actualidad, considerando dicha modernización; como una herramienta en aras de garantizar la subsistencia de los actos jurídicos, que facilite fundamentalmente, no solo la búsqueda de los archivos, sino la expedición de testimonios y certificados en línea, y permitiendo además, que el usuario tenga la convicción de la seguridad jurídica al expedirse dicha documentación conforme la ley lo establece. Para la concreción de los objetivos, este examen es basado en una investigación no experimental, de enfoque cualitativo; de tipo explicativa, documental; que maneja métodos teóricos y empíricos, enfocado, además, en lo dispuesto en el art. 19 de la Ley Notarial, y los arts. 4, 6 y 9 del Reglamento del Sistema Notarial Integral de la Función Judicial, que no contempla la emisión de certificados y testimonios en línea, digitalización de documentos notariales del archivo, ni la consideración del uso de un sistema informático para la realización de una búsqueda concreta, lo expuesto para fundamentar la necesidad de la modernización del sistema notarial respecto de la expedición de testimonio y certificados en línea. |
