| Abstract: | The objective of this academic research is to analyze the administrative protection measures included in the Legal Code for Children and Adolescents, to incorporate within the Ecuadorian legal system, the regulation regarding urgent administrative measures, their definition and detailed procedure. To analyze the main legal issue, I used theoretical contributions with the help of a psychosocial approach and the Ecuadorian regulatory framework. In this way, it begins by studying in detail the concept and interpretation given to administrative protection measures by various doctrinaires and international organizations such as the United Nations and the Inter-American Court of Human Rights, as well as the effects that arise from these. administrative actions. |
| Description: | El presente trabajo investigativo tiene como objetivo analizar las medidas administrativas de protección incorporadas en el Código Orgánico de la Niñez y Adolescencia, con el fin de incorporar dentro del ordenamiento jurídico ecuatoriano la regulación en cuanto a las medidas administrativas con carácter de urgente, su defición y procedimiento detallado. Para el análisis se utilizaron aportes teóricos con enfoque psicosocial y el marco normativo ecuatoriano. De esta manera, se comienza estudiando de forma detallada el concepto e interpretación otorgado a las medidas administrativas de protección por parte de varios doctrinarios y organismos internacionales como las Naciones Unidas y la Corte Interamericana de Derechos Humanos, así como también los efectos que surgen de estas acciones administrativas. Por consiguiente, en el capítulo final de esta investigación, se concluye que existe un contraste entre las medidas administrativas generales y las urgentes, por lo tanto, debería implementarse un reglamento el cual establezca un procedimiento especial para la aplicación estas medidas. |
