| Resumen : | The complete investigative legal analysis regarding the study of doctrinal and legal conceptual definitions of Social Protest in Ecuador; and the impact on the citizens who are part of the society of this country; necessary investigation so that the legal imposition of sanctions issued to the different acts or omissions carried out by citizens are not violated. Right to Freedom, and, to Justice inherent to the citizen, and its weak confrontation with reality equivalent to Ecuadorian criminal law; that is, classified as crimes that are confused with this Law where a citizen who manifests in a social protest is sanctioned. As a tireless search for eternal Justice on respect for Political Rights and the legitimate Right to social protest in Ecuador, this academic article ends with suggesting a reform proposal in the Comprehensive Organic Penal Code. |
| Descripción : | El análisis jurídico investigativo completo respecto al estudio de definiciones conceptuales doctrinarias y jurídicas de la Protesta Social en el Ecuador; y el impacto en los ciudadanos que forman parte de la sociedad de este país; investigación necesaria para que la imposición jurídica de sanciones emitidas a los distintos actos u omisiones llevados a cabo por la ciudadanía no resulten vulnerados. Derecho a la Libertad y a la Justicia inherente al ciudadano, y su débil confrontación ante la realidad equivalentemente de la normativa penal ecuatoriana; es decir catalogado como delitos que son confundidos con este Derecho donde se sanciona y penaliza a un ciudadano que manifiesta en una protesta social. Como búsqueda incansable de la eterna Justicia sobre el respeto a los Derechos Políticos y el Derecho legítimo a la protesta social en el Ecuador, este articulo académico finaliza con sugerir una propuesta reformatoria en el Código Orgánico Integral Penal. |
