Abstract

The present case analysis had the general objective of analyzing the State's competence in the care of people with psychiatric illnesses deprived of liberty, especially the case of the Ecuadorian State against Jorge Ezequiel Samaniego Sánchez, for which the responsibility of the State was described in relation to persons deprived of liberty, the violation of the rights of persons with psychiatric illnesses who have been the subject of a criminal conviction was demonstrated, as well as an analysis to determine the rights that were violated in the Jorge Ezequiel Samaniego Sánchez Case. The methodology was qualitative, since it started from the analysis of a specific case and the analysis of interviews that were carried out in depth, an observation guide was used in the same way to show that the conclusions of the work were the product of the application of the scientific method. The results of the investigation showed that at present the State does not have prisons that protect the right to health of people who have been sentenced as a result of a psychiatric illness, an emblematic case that of Jorge Samaniego, that despite having been diagnosed with paranoid schizophrenia, today he is serving a sentence in the penitentiary center of the city of Loja. The investigation concluded by noting that the rehabilitation of a psychiatric patient who is sent to a penitentiary will never be achieved, because it is sent jointly because it can never be rehabilitated there because there are no special conditions for it.
