Abstract

The country is currently experiencing a concerning rise in crime, which has led to a high crime rate and a social insecurity issue. Despite the efforts of the legal system to implement security measures, these have not been effective enough for the government to address this scenario in terms of social security. The principle of necessity may be applied when individuals carry a weapon, provided they meet the necessary requirements, justification, and verification in the event that it is used. This legal principle is invoked when an individual commits an illicit act to prevent a greater harm. The punishment for carrying a weapon is outlined in Article 360 of the Organic Integral Criminal Code, and it should be evaluated to determine its appropriateness, particularly regarding applying the Principle of Necessity for civilians.
