Abstract

The purpose of this investigation is to analyze the violation of constitutional rights due to the lack of notifications of traffic violations, especially the right to defense and due process. Every state must ensure that the rights of its citizens are protected and when they are violated, full reparation for the damages caused must be guaranteed under the mechanisms provided in the legal system. Constitutional rights are affected on a daily basis by the lack of notifications of traffic violations, which makes it difficult to freely exercise their rights by challenging the sanctions imposed. This study is focused on finding a legal solution with the intention of making statutory alternatives available such as the comprehensive reparation of the rights of people who are affected by the omission or improper way of notifying a traffic violation by the competent authorities, in order to improve the protection of the rights of offenders.
