Abstract

The notarial system in Ecuador, being an auxiliary body of the judicial system, has the power to give public faith to certain acts and documents, additionally it has a function of preventive legal security and also complies with the principle of immediacy and formality, however, this function is performed without adapting to new techniques such as electronic signature and digital platforms to appear. For this reason, it is necessary for the notarial system to be digitized in order to guarantee the principles that govern the judicial system, such as speed and procedural economy, and additionally accessibility to public information, for which it is consequently necessary to digitize public deeds and establish a digital platform that grants access to the notarial system in our country, for which protocols and regulations have been issued but their application in practice has not been promoted. That is why this research focuses on demonstrating the need for the creation of the digital notarial system based on current principles and a history of technology implementation in other systems such as judicial and registry.
