Propuesta de regulación de las criptomonedas, el uso compensatorio y su riesgo en el mercado ecuatoriano.

Abstract

Money has evolved in human history, taking various forms and geopolitical values and impressions. And it is that it is seen as an important tool for trade, but also from the ability to strengthen or weaken nations. The objective of this study is to analyze the regulation of cryptocurrencies, their compensatory use and the risk to propose a criterion for their circulation in the Ecuadorian market, for its compliance it was necessary to analyze the feasibility of regulating cryptocurrencies in the country and investigate regulation strategies. and control, to be applied, in order to minimize the risk due to the compensatory use of cryptocurrencies in Ecuador, all this considering its compensatory use against legal tender and integrating the risk that using it in the Ecuadorian market would imply; For this, it was necessary to describe the theoretical and characteristic background of cryptocurrencies, and identify the legal and regulatory framework of cryptocurrencies, as well as the systems available in various countries of the world and in Latin America, in order to describe the operation of cryptocurrencies and the risk for its use and analyze the need to regulate cryptocurrencies in the Ecuadorian market. The methodology of the study was of a quantitative and documentary bibliographic type, the technique that was applied was the survey and as an instrument the bibliographic record and the survey questionnaire. As a result, the adequate conceptual categories to regulate such a new phenomenon have not yet been developed; From a practical and financial point of view, cryptocurrencies have not reached enough importance to justify the regulatory effort they demand to replace traditional currencies. The suggestions that arise from the study is that to regulate cryptocurrencies there is a risk of introducing ineffective and superficial modifications that could harm certain actors, such as new users and those who want to experiment with these technologies. The foregoing led to the identification of regulation and control strategies to be applied in order to minimize the risk due to the compensatory use of cryptocurrencies in Ecuador.
