Abstract

Justice of the peace constitutes an alternative method to the solution of disputes of a judicial nature, which enjoys the legitimacy, simplicity, streamlining and decongestion of the ordinary system, being an important actor in the justice system and guaranteeing the right of access to it in territories rural and difficult to access. With the objective of analyzing the exercise of constitutional control over the procedure of the justice of the peace, in the case of the Portoviejo canton, the present investigation enjoys a methodological design with a qualitative approach, whose design is phenomenological, of a socio-legal type, whose Information analysis methods are the analysis and synthesis method.
