Abstract

This thesis direction goes to a deeper analysis of a critical problem of both social and academic relevance. The situation of Human Rights within the Ecuadorian penitentiary system. The author aims to unravel the complex dynamics between penitentiary conditions and their effect on the dignity and fundamental rights of individuals deprived of freedom. Fundamental rights issues such as overcrowding, violence, lack of access to basic services, and the inefficiency of rehabilitation and reintegration programs are explored. Indeed, this thesis emphasizes that the methodology employed is qualitative, as it allows for a deep understanding of the experiences lived by those deprived of liberty. It addresses how these violations negatively impact the reintegration and rehabilitation processes, preventing inmates from effectively reintegrating into society. This thesis proposes the implementation of rehabilitation and penitentiary management models based on international practices that have proven effective in other countries. These recommendations aim not only to mitigate human rights violations but also to reform the Ecuadorian penitentiary system towards a structure that prioritizes human dignity, restorative justice, and the effective social reintegration of prisoners. Last but not least, this research hopes to contribute significantly to the debate on penitentiary reform in Ecuador, offering evidence-based perspectives that can be used to formulate policies and reforms to drive legislative and administrative changes ensuring fair and humane treatment of prisoners
