This paper delves into the interpretative methodology focusing on the favorability of rights within the Ecuadorian civil law framework. It scrutinizes the effect of this hermeneutical approach on the protection and advancement of fundamental rights, exemplified through the scrutiny of the ruling 11-18-CN/19 on equal marriage. The article breaks down the interpretative process, contending that a rightsfavorable reading is crucial for social and legal progress. Recognizing the challenges inherent to this method, the paper emphasizes its significance in molding laws to the evolving demands of society, especially concerning marriage equality. It also tackles the history of marriage in Ecuador to provide context for the favorable interpretation that ultimately granted marriage rights to same-sex couples. The research posits that the favorability interpretation is a potent tool for furthering justice and equality.
