Abstract

The problem identified in the case of the Municipal Government of Pedro Carbo is centered on the normative vacuum in the regulation of the workers who provide services in the municipal slaughterhouse. After the repeal of the Organic Law of the Municipal Regime and the entry into force of the Organic Code of Territorial Organization, Autonomy and Decentralization (COOTAD), a regulatory gap was created with respect to slaughter services. In this context, the municipal government has opted to offer services through a labor simulation, in which slaughterers are hired by livestock introducers, but in practice, they obey the authorities of the administrative unit and those responsible for the service, evidencing a subordination of the slaughterer to third parties that are not the ones who hired him.
