Uso no autorizado de la voz ajena en la legislación ecuatoriana.

Abstract

The human voice, as a unique biometric data, is an essential element of personal identity. However, in Ecuadorian legislation, while voice protection is recognized in the Constitution and the Organic Code of the Social Economy of Knowledge, Creativity, and Innovation – INGENIOS, there are still legal gaps that allow its unauthorized use and exploitation, especially with the advancement of technologies such as artificial intelligence. This thesis analyzes the current legislation, identifying its limitations and proposing reforms to strengthen voice protection as biometric data and as an object of copyright. A specific legal reform is proposed to integrate voice as biometric data in the Organic Law on Personal Data Protection and to reinforce its protection in the INGENIOS Code, especially in the context of artistic interpretation and the use of emerging technologies.
